CASE STUDY

Client slipped on water left by cleaner on hardwood floor.

Our client in this case was a factory worker who slipped on a wooden floor that had been mopped only a few minutes previously.

The cleaner had commenced her duties before the period or time usually allowed and there were a number of colleagues in the area still working. The cleaner also failed to put up warning signs to advise her co-workers of the danger. Our client failed to notice the wet floor and fell injuring his back badly.

The employers were vicariously liable for the actions of the negligent employee. They were in beach of the Workplace (Health, Safety & Welfare) Regulations 1992 which cover many aspects of safety at work.
