Once the evidence for both special and general damages has been agreed and fully disclosed both parties can consider entering into settlement negotiations.

Usually the employers insurers will make an opening offer which may be broken down into the two key areas of special & general damages or very often a "global offer" will be made.

It is up to your solicitor to advise you on the suitability of any offer and you should always be certain that your injuries have recovered (or certainty has been reached regarding your prognosis) before you settle the claim.

There is no second chance - once you settle, you really do SETTLE.

 


Your legal costs will always form part of any agreed settlement subject to constraints with Part 36 offers and other issues that might affect the negotiations. In the vast majority of cases, legal fees are paid by the employers insurers.
