Builder and contractor jailed on manslaughter charges
Two men were jailed for manslaughter after a 15-year-old labourer was crushed under a wall - 23rd July 2009
Two men have been jailed following a
workplace accident on 23rd April 2007 in which a
15-year-old labourer, Adam Gosling died from severe
head
injuries sustained at work.
Adam's accident
at work happened as he and his brother were
demolishing a wall with no
instruction or supervision and no risk
assessment having been carried out.
During the demolition the wall leant towards a
neighbouring garden, so Adam went to inform Builder
Colin Holtom who he and his brother were working
for, he apparently instructed them to go into the
neighbour's garden and push the wall back.
As Adam tried to push the wall back it began falling
towards him, his brother shouted to him to get out
of the way but the wall fell onto him trapping him
against a garage causing him massive head injuries.
The London
Fire Brigade,
air
ambulance,
paramedics and
police
attended the scene and managed to free Adam, but
tragically he was pronounced dead at the scene.
Builder Colin Holtom was jailed for three years
after pleading guilty to manslaughter, Project
Manager Darren Fowler was jailed for a year for
working whilst disqualified from being a company
manager, and for failing to discharge a duty imposed
by Section 2(1) of the Health and Safety at Work Act
1974 - contrary to Sect 33(1a) of the said Act.
